1. Scope of these Terms
These Terms & Conditions ("Terms") govern your use of this website for the SHOPin frontend accelerator (the "Website"). The Website is operated by creativestyle GmbH, with registered office at Erika-Mann-Straße 25, 80636 München, Germany (collectively "we", "us" or "our").
The Website is intended to present and document an open source project and to support evaluation and development work with the SHOPin frontend accelerator. It does not itself provide a production service, conclude contracts or process end-customer transactions. A separate demo environment is operated under its own domain at demo.shopin.dev and may be subject to additional or different terms of use. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Website.
2. Nature of Information and Services
The content on this Website is provided for general information about the SHOPin frontend accelerator, its open source codebase and integrations, and related topics. It does not constitute legal, commercial or technical advice and should not be relied on as such. While we take reasonable care to keep the content up to date and accurate, we do not guarantee that the information on the Website is complete, accurate or current.
Any information about features, integrations, performance or other characteristics of SHOPin is for illustrative purposes only and may change at any time without notice. Because SHOPin is under active development as an open source project, the demo and documentation on this Website may at times differ from the current state of the corresponding source code and configuration in our public repository at github.com/creativestyle/shopin.
In particular, architecture diagrams, code samples, configuration examples and other documentation content are non-binding suggestions intended to support your own evaluation and development. You remain solely responsible for how you implement, configure and operate any systems based on or inspired by the documentation, including compliance with applicable law, security, performance and suitability for your specific use case.
3. Use of the Website
You may use the Website only in accordance with these Terms and applicable law. In particular, you agree not to:
- use the Website for any unlawful or fraudulent purposes;
- attempt to gain unauthorised access to the Website, servers or networks connected to the Website;
- interfere with or disrupt the proper functioning of the Website (e.g. via malware, automated scripts or excessive requests);
- circumvent or attempt to circumvent security or access control measures used on the Website;
- use the Website in a manner that could harm us, other users or third parties or impair the availability of the Website.
4. Intellectual Property
Unless otherwise indicated, and with the exception of the open source software described in Section 5, all content on the Website, including text, graphics, logos, images, user interface elements and design, is protected by copyright and other intellectual property rights and is owned by us or our licensors.
You may view and use the Website and its content for your own business purposes, including the evaluation and development of implementations or integrations for third-party clients, in connection with the evaluation and use of SHOPin. Any other use, in particular reproduction, distribution, modification, public display or any other form of exploitation (including reselling or sublicensing the documentation itself), is not permitted without our prior written consent, unless a statutory exception applies.
5. Open Source Components
SHOPin is provided as an open source accelerator. Any use of the SHOPin software itself is subject to the applicable open source licence terms, in particular the Open Software License 3.0 (OSL-3.0), which is made available in the public repository at github.com/creativestyle/shopin. In the event of conflict between these Terms and the applicable open source licence terms, the open source licence terms shall prevail with respect to the relevant software components. Your integration of SHOPin into your own systems, and any modifications or extensions you create, are carried out on your own responsibility.
6. Third-Party Links and Integrations
The Website may contain links to third-party websites or display content from third parties, for example demo environments of commerce or search providers, the GitHub repositories hosting the SHOPin open source codebase, or documentation of tools and services we use. We have no control over the content of such third-party sites or services and accept no responsibility for them. The inclusion of such links or content does not imply endorsement by us.
Your use of third-party websites or services is subject exclusively to the terms and privacy policies of those third parties.
If, in the future, a contract with a consumer is concluded directly via this Website, the consumer's statutory right of withdrawal (Widerrufsrecht) shall remain unaffected by these Terms.
7. Liability
We are liable without limitation for damages resulting from intent or gross negligence on our part, as well as for damages resulting from injury to life, body or health. We are further liable in accordance with mandatory statutory provisions, such as the German Product Liability Act (Produkthaftungsgesetz).
In all other cases, our liability for slightly negligent breaches of essential contractual obligations (cardinal obligations) is limited to the foreseeable damage typical for the contract. Essential contractual obligations are those whose fulfilment is necessary to achieve the purpose of the contract and on whose compliance you may regularly rely.
Any further liability for slight negligence is excluded. To the extent that our liability is excluded or limited, this also applies to the personal liability of our legal representatives and vicarious agents.
8. No Warranties
The Website is provided on an "as is" and "as available" basis. Except where expressly stated otherwise or required by law, we make no warranties or representations of any kind, whether express or implied, regarding the availability, accuracy, reliability or suitability of the Website or its content for any particular purpose.

10. Governing Law and Jurisdiction
These Terms and any disputes arising out of or in connection with them or with your use of the Website are governed by the laws of the Federal Republic of Germany, excluding its conflict of laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG).
If you are a merchant ("Kaufmann"), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms or your use of the Website shall be München, Germany. Statutory provisions on the place of jurisdiction for consumers remain unaffected.
11. Changes to these Terms
We may modify these Terms from time to time, for example to reflect changes in legal requirements or in the operation of the Website. The current version is available on the Website. If we make material changes that affect your rights or obligations, we will inform you of this in an appropriate manner, where required by law.
